Georgia DUI law says it is an offense for operating a motor vehicle when your ability to do so was through the use of alcohol or drugs. This includes both legal and illegal substances, including drugs.
There are two ways for the government to driving under the influence. The first is from a police officer during a formal presentation that you are operating your vehicle dangerously while under the influence of alcohol, even a drink. But you can also be condemned, if you have a legal blood alcohol level of 08 percent, regardless of whether you had the problems with driving.
If you moved more than a routine traffic stop and the officer suspects you intoxicated, according to Georgia DUI law, he may field sobriety test. You are invited to a test to determine sobriety. One of the best known of these is the "straight line", where you can walk a straight line heel to toe and turn at the end again. The officer could also ask you a Penlight with your eyes.
If the officer feels that you are intoxicated, they will ask for a chemical test. This can be a blood, breath or urine test. If you do not agree, such a test, your driving skills will lose privileges. A breathalyzer test may be the roadside, while the blood or urine tests must be done in a hospital.
If you are convicted, the court may impose fines, jail time, probation and community service work for you. They can be used to attend AA meetings or the installation of an interim device on your car, this is not possible to start, if your blood alcohol level over 02 percent. After Georgia DUI law, there are minimum sentences for first offenses and repeat offenses more severe consequences.
Some of the factors that the sentencing in a history of DUI counts, regardless of whether you are operating a vehicle, whether it is a child in the car, if another moving violation occurred, regardless of whether someone was injured or killed , and whether the driver was under the permitted minimum age for alcohol consumption reached.
The consequences for driving under the influence are quite heavy, and you should know that in the summer of 2008, Georgia DUI law was much stricter.
