According to a survey by the Statistics Center of Dubai in 2006, approximately 85% of the population of Dubai was the expatriates. Majority of them lives in rental units. It's solely on the landlord's mercy." Rising rents have long been the largest concern for those abroad, with rents doubled and tripled in the shortest time. The relationship between tenants and landlords increasingly tensed with issues like landlords vehemently asking tenants to vacate house without prior notice. Dubai first government responded by rental caps and now a new law signed by His Highness Sheikh Mohamad Bin Rashid Al Maktoum on November 26, 2007 was introduced. Read on to see what kind of changes that they make.
Tenant's Point of View:
Tenants are facilitated in many ways by this Act. For example,
• The solution to the problem of the abnormal increase in rents, this law prevents any increase or modification of the lease for the first two years.
• Decision will rent the use of tools such as car parks or swimming pools. Owners must be in sound quality.
• Article 16 of this Act the responsibility of maintenance to landlord. But the next article states that landlord shall not make any change, the impact on the tenant benefit in any way.
• The landlord can not force tenants to leave before the expiry of the contract with exceptions such as the tenant does not pay rent or if the tenant starts with the property for some immoral purpose, etc.
• If the reason for the eviction is disclosed possible collapse of the property, because of its poor condition, Landlord shall provide a technical report from Dubai city.
• Another remarkable point of this law is that if the landlord re-property for his / her own use after the expiry of the contract, he can not rent to other persons for a period of one year. If it happens, the tenant can take legal action against him.
• Tenants should be aware that only those contracts that are in written form and with RERA.
Landlord's Perspective:
• landlord decided to rent at the time the contract for two years. Against this background, they can decide a reasonable rent, taking into account factors such as inflation and time value of money.
• After two years, rent can be changed. If both parties do not amount to this revision, this dispute will be sent to Judicial Committee, which will then decide the amount of rent.
• This law does not apply to the hotel and the accommodation provided to employees by their companies.
• The landlord is entitled to rent value on agreed dates.
• The tenant can not make any changes to the property without the consent of the landlord.
• All taxes and levies to the Government of tenants.
The new law would require a review of the alarmingly increasing tenant problems. However, there are some defects, which are treated in the near future hopefully.
