We all know that the use of safety belts and child safety restraints essential safety equipment, in addition to the daily driving routine. Wearing of seat belts and ensure a child is securely strapped into a suitable restriction is now second Nature on an overwhelming majority of motorists.
The law on seat belts and child safety restraints, however, is not as easy as you might think, and given the fact that the violation of the law can lead to a fine of up to € 500 and three points on the license.
The easiest part of the Act states that a driver must wear a seat belt while driving if one is available. Of course there are exceptions. The driver does not wear a seat belt, while the reverse, delivery driver for a ride of less than fifty meters are also exempt persons from certain medical conditions, and if there are no seat belts then is no insult.
A car driver is also responsible for ensuring that all passengers over the age of fourteen safety belts. Any person over the age of fourteen must take responsibility for themselves.
A child under the age of three years can not legally before the rear of the vehicle, unless restrained by an approved restraint system that the safety of children is for their age or weight. The only exception is when traveling in a taxi that does not have such restraint systems.
Once a child at the age of three years, the law is becoming increasingly complex. Between three and twelve years of age or 135cm in height of a child shall not travel in the passenger seat without the appropriate child restraint systems. However, you can travel in the rear without restraint when the seat belts are not available. If safety belts are the correct restrictions are used. Exceptions to the back seat of the Regulation allows travel with children aged three to twelve years under 135cm with the safety belt for adults without children, if they are for a short distance from unexpected necessity and restraint is not available, or the use of two other occupied children to prevent a third or if the back is a taxi.
Once a child has reached twelve years of age or over 135cm in height they can be front or rear seat with an adult belt if one is available. Failure to comply with a strap to punish the driver. Children over 135cm or twelve years, in a rampant front or rear of a vehicle if seat belts are not.
