In today's society, it is very easy to create a credit card. Unfortunately, some people have too many credit cards, then you can not keep pace with the payments. The credit card company sends you a warning, and threatening a lawsuit. Then either the claim or your claim is due to the dreaded collection agency, which again is threatening a lawsuit.
Based on my experience with my clients, I have also found that debt collection agencies threaten other things, such as garnishing your wages. I really like these words from my mouth customers because it means that the debt collector has violated the Federal Republic of Fair Debt Collection Practices Act, and my client now has a lawsuit against the debt collector.
In Pennsylvania, neither a credit card company or a debt collection agency garnish your wages at any time, even if they threaten to do so.
Attachment of wages in PA can only in very limited circumstances. The first case is for a child or spouse support. The second circumstance is for the recovery of PHEAA student loans. The third is after a decision is required for accommodation and meals for 4 weeks or less. Fourthly, for the back rent on a residential lease, and the fifth, to ensure commitment to a final divorce distribution.
As you may have noticed on a civilian credit card debt is not only one of the listed cases in which garnishment occur. However, it should be noted that a credit card or a debt collection agency garnish your bank if they have a valid ruling against you in court. Threats to garnish accounts before obtaining a final court decision are violations of federal law. It must also be pointed out that when your wages are deposited into your bank account, they no longer pay. They simply mesh opening into the body of your bank account, and are under garnishment, when a verdict is against you.
