notary law of the State of California has once again ..... The new changes seem appropriate that they pull the tape to the determination of the signatories, the use of thumb pressure on power of attorney forms, and penalties for notaries that do not follow the law. For the law, please read the original text from the California Secretary of State. The latest updates for California Notary Law are:
-The new procedures adopted by the Department of Justice and State Secretary in the commissioning of new notary applicants, the Ministry of Justice has the right to their increased costs to the plaintiff.
Notary applicants must now submit a photo of her person for the Commission.
Notaries can-not with a post office box or commercial mail receiving agency as their principal place of business, unless they also provide a physical street address.
-All acts of notary must now show, the signatories call for proof of identity or two credible witnesses claiming knowledge about their identity. "" Personal Knowledge "the signer is no longer acceptable.
-Any credible witnesses needed to identify an individual signatories must provide evidence of their identity. (see above)
Notary wording to documents must be certified not the words "personally known to me" to cope with the change of identity.
-All notarizations attorney must be a thumb print of the signatories in the notary journal.
Law enforcement authorities now have the right to a notary the magazine, if there are reasonable grounds to suspect that the journal contains evidence of a crime.
-Penalties for illegal notarizations Notare implementing higher fines and possible abolition of the Commission.
This refers to the major changes. The changes appear appropriate for this day and age. By "personal knowledge" of an individual previously has always seemed kind of goofy when you consider how important it is for some of the types of documents, the trust - family trusts, wills, powers of attorney, etc.
